1. Scope and who we are

This Privacy Policy explains how NextPlay ("NextPlay," "we," "us," or "our") handles personal information when you visit or use the NextPlay website, Community Mural, forms, media experiences, and other features that link to this Policy (together, the "Site"). NextPlay operates from Texas, United States.

This Policy does not govern a third party's own website, platform, or service, even if it is linked or embedded on our Site. Those parties handle information under their own privacy terms.

2. Information we collect

Information you provide

  • Preferred first name. If you enter a preferred name in the welcome experience, the current Site stores that name in your own browser so it can greet you when you return. NextPlay does not receive the name through that feature unless you separately submit it elsewhere.
  • Community Mural content. If you contribute to the Community Mural, we may collect your display name, signature or drawing, prompt selection, message, optional city or location, placement and rotation details, supporter number, submission time, and moderation status. Your contribution is reviewed before it may appear publicly.
  • Contact and inquiry information. Depending on the form you use, this may include your name, brand or business, email address, telephone number, social handle, location, category or lane (such as Athlete, Creator, Entrepreneur, or Brand), project idea, and message. The main Contact form opens your email application; your email provider processes that communication. Other enabled inquiry forms may submit information through FormSubmit before it reaches NextPlay by email.
  • Direct communications. We collect what you choose to send when you email us, contact us through social media, or otherwise communicate with us.

Information collected automatically

The Site is built and hosted with Framer. Framer's built-in analytics may provide NextPlay with aggregated or anonymized information such as pages viewed, device type, browser, operating system, country, referrer, and approximate unique visits. Framer describes its built-in analytics as cookie-free and designed not to retain a visitor's raw IP address as an identifiable analytics record.

Embedded video, streaming, or social services—such as YouTube, Vimeo, Twitch, Instagram, TikTok, or LinkedIn—may receive technical information, including IP address, device details, page URL, and interaction data. They may use cookies or similar technologies under their own policies.

3. Browser storage and cookies

The welcome experience uses local browser storage to remember that you entered the Site and, if provided, your preferred first name. A temporary session marker may also support navigation into the Community Mural. You can remove these items by clearing this Site's data in your browser, although doing so may restart the welcome experience.

NextPlay's current first-party Framer analytics does not require analytics cookies. Embedded or linked third-party services may use their own cookies or similar technologies. Your browser and device settings may let you block or delete those technologies; doing so can affect embedded media.

4. How we use information

  • Provide, personalize, maintain, and improve the Site and its features.
  • Remember your preferred on-device greeting.
  • Review, moderate, display, organize, and protect Community Mural content.
  • Respond to contact, talent, creator, entrepreneur, brand, partnership, and campaign inquiries.
  • Understand Site performance and general audience engagement.
  • Protect users, enforce our Terms, prevent abuse or fraud, and maintain security.
  • Comply with applicable law and establish, exercise, or defend legal claims.

5. Community Mural and public content

The Community Mural is designed for public expression. If approved, your display name, drawing or signature, message, selected prompt, optional location, supporter number, and submission timing may be visible to anyone who visits the Site. Do not submit private, confidential, identifying, or sensitive information that you do not want made public.

Submissions may be stored while pending review. We may reject, hide, or remove content that violates the Mural Rules or our Terms, creates a safety or legal concern, or is otherwise unsuitable for the experience.

6. How we disclose information

We may disclose information in the following circumstances:

  • Publicly, at your direction. Approved Community Mural submissions are displayed publicly as described above.
  • Service providers. Providers that help operate the Site may process information for us, including Framer (site hosting and analytics), Supabase (Community Mural database and infrastructure), FormSubmit (enabled form delivery), and our email and technical service providers. FormSubmit states that it may retain form submissions for up to 30 days to provide its service.
  • Third-party media and social platforms. When you load or use embedded media or follow an external link, the relevant platform may receive information directly from you.
  • Legal, safety, and business reasons. We may disclose information when reasonably necessary to comply with law, protect rights or safety, investigate misuse, or support a merger, financing, reorganization, or transfer of all or part of NextPlay's operations.

As of the Effective Date, NextPlay does not sell personal information for money or use personal information for targeted advertising as those terms are defined by applicable U.S. state privacy laws. Third-party platforms may separately process information under their own terms.

7. Retention

We keep personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Site, maintain appropriate business records, resolve disputes, enforce agreements, and meet legal, security, or backup requirements.

Your preferred first name remains in your browser until you clear the Site's local data. Community Mural content may remain available until it is removed by NextPlay, moderation, or an applicable request, subject to reasonable backup and legal retention. Inquiry records are retained according to our operational and legal needs. A provider may keep data for its own stated service period, including FormSubmit's stated period of up to 30 days.

8. Your choices and privacy rights

You can choose not to submit information, omit an optional location from a Mural contribution, clear local Site data, or adjust browser settings for third-party cookies and embedded content.

Depending on where you live and whether a privacy law applies to NextPlay, you may have rights to request access to, correction of, deletion of, or a portable copy of certain personal information; to object to or restrict certain processing; to withdraw consent; and to opt out of certain sales, targeted advertising, sharing, or profiling. You may also have the right not to receive discriminatory treatment for exercising a privacy right.

Submit a request to info@nextplaymade.com with the subject "Privacy Request." Describe the Site feature and the right you wish to exercise. We may need to verify your identity and authority. If applicable law permits an authorized agent, we may request proof of that authority and direct confirmation from you. We will respond within the time required by applicable law.

If we deny an eligible request and your law provides an appeal right, email the same address with the subject "Privacy Appeal" and explain why you are appealing. You may also contact your state attorney general or other competent regulator where applicable.

9. Children and teens

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. A child under 13 must not submit a preferred name, Mural contribution, form, or other personal information. If we learn that we collected such information, we will take reasonable steps to delete it. Contact us if you believe a child under 13 submitted personal information.

If you are between 13 and the age of legal majority where you live, use the Site only with the permission and supervision required from a parent or legal guardian. Please do not publicly post personal contact details or sensitive information on the Community Mural.

10. Security and international processing

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No online system or transmission is completely secure, and we cannot guarantee absolute security.

NextPlay and its providers may process information in the United States and other countries. Those locations may have privacy laws different from the laws where you live. Where required, we rely on legally recognized safeguards for international transfers.

11. Changes to this Policy

We may update this Policy as the Site, our practices, or applicable law changes. We will post the updated version here and revise the Effective Date. If required, we will provide additional notice or request consent.
