1. Agreement to these Terms

These Terms of Use ("Terms") are a binding agreement between you and NextPlay ("NextPlay," "we," "us," or "our") governing your access to and use of the NextPlay website, Community Mural, forms, media experiences, and other features that link to these Terms (together, the "Site"). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of legal majority where you live, you may use the Site only with the permission and supervision required from your parent or legal guardian. A parent or guardian who permits a minor to use the Site agrees to be responsible for that minor's use to the extent permitted by law.

You may not use the Site if doing so would violate applicable law or if you previously lost access for violating these Terms.

3. What the Site does—and does not do

NextPlay showcases talent, creators, entrepreneurs, campaigns, community stories, and media; invites inquiries; and offers interactive community experiences. Content is provided for general informational, promotional, and creative purposes.

Visiting the Site, appearing on the Site, submitting an inquiry, or contributing content does not create an employment, agency, management, client, partnership, joint venture, fiduciary, or other professional relationship with NextPlay. No opportunity, representation, compensation, selection, response, or business engagement is promised unless stated in a separate written agreement signed by authorized parties.

4. Acceptable use

You agree not to:

  • Break the law or encourage unlawful, fraudulent, or harmful activity.
  • Harass, threaten, exploit, impersonate, discriminate against, or invade the privacy of another person.
  • Upload or submit content that is hateful, obscene, defamatory, infringing, deceptive, malicious, or sexually exploitative.
  • Post private contact information, sensitive personal information, spam, advertisements, malware, scraping tools, or unauthorized links.
  • Interfere with the Site, evade access controls, probe vulnerabilities, overload infrastructure, or attempt unauthorized access to systems or data.
  • Copy, harvest, scrape, train on, commercially exploit, or republish Site content except as authorized by law or written permission.

5. Community Mural rules

The Community Mural is a moderated public space. Keep contributions respectful, original, and appropriate for a broad audience. Use a name or signature you are entitled to use and share a short, meaningful statement. Do not submit hate, profanity, spam, advertising, links, personal contact information, impersonation, or content that covers or disrupts another person's contribution.

Mural submissions may be reviewed before publication. NextPlay may reject, edit only for technical display, reposition, hide, or remove any contribution at any time, including content that violates these Terms, creates a legal or safety risk, disrupts the experience, or is otherwise unsuitable. Moderation is discretionary and is not a guarantee that all content is accurate, appropriate, or continuously monitored.

A city, date, time, supporter number, name, message, and drawing may appear publicly with an approved contribution. Do not submit anything confidential or anything you do not want the public to see.

6. Your content and license to NextPlay

You retain any ownership rights you have in content you submit. You represent that you created or control the content, have all permissions needed to submit it, and that its use as described here will not violate law or another person's rights.

By submitting content, you grant NextPlay a non-exclusive, worldwide, royalty-free license, with the right to allow our service providers to act for us, to host, store, reproduce, display, format, technically adapt, distribute, and promote that content in connection with operating, improving, documenting, and promoting NextPlay, the Site, and the Community Mural. This license lasts while the content is used for those purposes and for a reasonable period in backups and materials already created. To the extent the law allows, no compensation or guaranteed attribution is owed.

Public submissions are not confidential. If you want us to consider removing your content, email us with enough detail to locate it. We will evaluate the request under applicable law, our records, and legitimate operational needs.

7. Forms, opportunities, and communications

Information submitted through contact, talent, creator, entrepreneur, brand, campaign, or partnership channels must be accurate and must not violate another person's rights. Unless NextPlay separately agrees in writing, unsolicited ideas and inquiry materials are not confidential, and NextPlay has no obligation to review, respond to, return, compensate, or pursue them.

Do not send trade secrets or other confidential material through the Site. A response, conversation, meeting, or review does not create a professional relationship or guarantee an opportunity.

8. Live and interactive features

Live, chat, poll, reaction, countdown, and similar experiences may be previews, demonstrations, embeds, or locally generated interactions. Unless the interface clearly says otherwise, do not assume that an on-screen message, vote, or reaction is transmitted to NextPlay, saved, monitored, or used to make a decision. Availability and functionality may change without notice.

9. NextPlay content and intellectual property

The Site and its design, branding, text, graphics, photographs, video, audio, software, animations, databases, and other content are owned by NextPlay or used with permission and are protected by intellectual property and other laws. Talent, creator, entrepreneur, client, partner, and third-party names, images, marks, and works remain the property of their respective owners.

NextPlay gives you a limited, revocable, non-transferable, non-exclusive right to access and use the Site for personal, lawful, noncommercial purposes. No other right or license is granted. You may not use NextPlay names, logos, or brand elements without prior written permission.

10. Third-party services and links

The Site may link to or embed services operated by Framer, Supabase, FormSubmit, YouTube, Vimeo, Twitch, Instagram, TikTok, LinkedIn, and others. NextPlay does not control and is not responsible for third-party content, availability, security, privacy, or practices. Your use of a third-party service is governed by that party's terms. A link, embed, talent listing, or brand reference does not by itself imply endorsement or affiliation.

11. Disclaimers

To the fullest extent permitted by law, the Site is provided "as is" and "as available." NextPlay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and results.

We do not guarantee that Site content is complete, current, error-free, or continuously available; that submissions will be published; or that the Site will be free of harmful components. Nothing on the Site is legal, financial, medical, employment, career, or other professional advice.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, NextPlay and its owners, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, goodwill, or reputation; or losses arising from third-party conduct, content, services, or links, even if advised that such damages are possible.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Your statutory consumer rights, if any, remain intact.

13. Your responsibility

To the extent permitted by law, you agree to defend, indemnify, and hold harmless NextPlay and its owners, personnel, affiliates, and service providers from claims, losses, liabilities, and reasonable costs arising from your content, your misuse of the Site, or your violation of these Terms, applicable law, or another person's rights. This obligation does not apply to the extent a claim results from NextPlay's own unlawful conduct.

14. Suspension and termination

We may suspend, restrict, or end access to the Site or a feature, and may remove content, when reasonably necessary to protect the Site or users, enforce these Terms, comply with law, address risk, or change or discontinue a service. You may stop using the Site at any time. Provisions that by their nature should survive termination will survive, including intellectual property, license, disclaimer, liability, responsibility, and dispute provisions.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where the law where you live requires otherwise. Any dispute that is not resolved informally may be brought in a court of competent jurisdiction in Texas, subject to any non-waivable rights you have under applicable law. Before filing a claim, you and NextPlay agree to make a good-faith effort to resolve it by written notice, unless urgent relief is reasonably necessary.

16. General terms

We may update these Terms by posting a revised version and updating the Effective Date. Continued use after the revised Terms become effective means you accept them to the extent allowed by law. Material changes will receive additional notice when required.

If a provision is unenforceable, it will be modified only as much as needed and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; NextPlay may assign them in connection with a reorganization or transfer of operations. These Terms and the Privacy Policy are the complete agreement about your use of the Site, except for a separate written agreement that expressly controls a particular service.
